2026 Legal Terms Update

We recently updated our legal documents to reflect the growing range of services offered by Entrepositive. These updates help ensure clarity, transparency, and consistency across our Terms & Conditions, Privacy Policy, Disclaimer, and Definitions of Services.

Here’s a quick overview of what changed:

  1. Clearer explanation of the services we offer
    We expanded our Definitions of Services to include the full range of marketing services we provide, including content creation, campaign management, consulting, training, and our Salespositive™ marketing automation platform. This update helps customers better understand what each service category includes.
  2. Addition of Client Service Agreements
    We added simple references noting that certain services (especially customized marketing or consulting projects) may be governed by a separate Client Service Agreement. These agreements may clarify or expand on the general terms.
  3. Improved clarity around client responsibilities
    We added small clarifications that clients are responsible for ensuring their contact lists, marketing claims, and materials comply with relevant laws (such as email and SMS regulations). This was added to ensure shared understanding and transparency.
  4. Updates related to client‑provided data
    Our Privacy Policy now includes a short section explaining how we handle customer lists, platform credentials, and other client‑provided data for marketing or consulting work. We only use this data to deliver services on your behalf.
  5. Clearer expectations around results
    We added language to explain that we cannot guarantee specific business results—such as revenue increases, deliverability, or campaign performance—from any of our services. This aligns with industry standards and avoids misunderstandings.
  6. Clarification about third‑party platforms
    Because many of our services depend on third‑party tools (like email providers, ad platforms, or CRMs), we added a brief note clarifying that we’re not responsible for outages, policy changes, or performance issues caused by those external platforms.
  7. Small, general clarifications for consistency
    We made a few light adjustments across documents to ensure all terms work smoothly together and accurately reflect how we operate today.

  • Added Definition of Services section titled Agency and Consulting Services, grouping services into five categories.
  • Renamed the Salespositive™ section to “the SaaS” in the Definition of Services.
  • Added Definition of Services section titled Service Agreements May Override or Expand Terms.
  • Added “Agency Services” and “Client Service Agreement” to the Terms and Conditions Definitions.
  • Added Client Materials license clause to the Terms and Conditions Intellectual Property section.
  • Added performance / no‑guarantee language to the Terms and Conditions No Warranties section.
  • Added compliance responsibility sentence to the Terms and Conditions Indemnification section.
  • Added clause to the Terms and Conditions Entire Agreement section noting that a Client Service Agreement may override certain terms.
  • Added clarification to the Terms and Conditions Termination section regarding ongoing obligations under Client Service Agreements.
  • Added Third‑Party Platforms clause to the Terms and Conditions Miscellaneous section.
  • Added Privacy Policy section titled Client‑Provided Data for Marketing and Consulting Services.
  • Added bullet to the Privacy Policy Purposes for Collecting Information section regarding processing Client‑Provided Data.
  • Added sentence to the Privacy Policy Third Parties We Share Information With section regarding client‑directed platforms.
  • Added sentence to the Privacy Policy Your Choices section regarding deletion or modification of Client‑Provided Data.
  • Added sentence to the Privacy Policy How We Protect Your Personal Information section clarifying restricted access to Client‑Provided Data.
  • Added Disclaimer section titled No Guarantee of Results.
  • Added sentence to the Disclaimer Not Professional Advice section clarifying that marketing and strategy guidance is not legal or financial advice.
  • Added Disclaimer section titled Third‑Party Platforms.
  • Modified Definition of Services Scope of Usage by changing the line about unlimited usage to “Data usage, number of emails sent, and number of contacts added to Salespositive™.” so these may be limited.
  • Updated Definition of Services Delivery Method by renaming it “Salespositive™ Delivery Method” and replacing occurrences of “the Service” with “the SaaS,” including one instance in Support and Maintenance Services.
  • Modified Definition of Services Performance Standards to change “The Service is hosted on its own virtual private server” to “The SaaS is hosted on a virtual private server.”
  • Updated Terms and Conditions Definitions by changing “Product, Service, Salespositive™ or Subscription Service” to “Product, SaaS, Salespositive™ or Subscription.”
